Biodiesel production is not a farm use, says N.C. Appeals Court

N.C. Court of Appeals reversed the ruling that biodiesel fuel is a bona fide farm use.
The ruling, which was issued on April 7, sends the case between Iredell County, Phil and Mike McLain and the Iredell Neighbors for Rural Life back to Iredell County Superior Court.
The original ruling by former Iredell County Superior Court Judge Kimberly Taylor allowed the McLains to produce up to 500,000 gallons of biodiesel fuel on their property.
The lawsuit was filed in September after Iredell County Commissioners rezoned a parcel of McLain Farms on Snow Creek Road from single-family residential to heavy manufacturing.
